Blick Art Materials, LLC (“Blick,” “we,” “us,” or “our”) respects the privacy of its employees, independent contractors, and job applicants. This Employee and Applicant Privacy Notice (“Privacy Notice”) explains what Personal Information we collect, and how we use, share and protect that Personal Information when you apply for a job with Blick, are employed by Blick, or are an independent contractor for Blick.

This Privacy Notice only applies to your use of the portion of Blick’s website (“Site”) that allows you to review job postings, apply to work with Blick, or view your applicant account. If you access or use any other part of Blick’s Site, please note that Blick’s general Privacy Policy, rather than this Privacy Notice, applies to all other access and use of the Site. If there is a conflict between this Privacy Notice and our more general Privacy Policy, this Privacy Notice controls with respect to job applicants and employees.
References to employment, engagement, personnel, employees or similar terms in this Privacy Notice are used for convenience only. This Privacy Notice does not confer employment status on any non-employee, does not form part of any employment or engagement contract, and does not create contractual rights or obligations between you and us.
California Residents Only. If you are a resident of California, you may have additional rights which are set forth at the end of this Privacy Notice in the Section titled ADDITIONAL RIGHTS FOR CALIFORNIA RESIDENTS.
Changes to this Privacy Notice. We may update this Privacy Notice from time to time. Any changes will be effective immediately upon posting. If we make any material changes, we will notify you by posting a notice at the top of the Site or application page, within your account, or by otherwise contacting you.
As of the Effective Date, Blick uses a third-party platform (the “Dayforce Platform”) provided by Dayforce, Inc. and its affiliates (“Dayforce”) to help manage the job application process for those who apply for jobs through Blick’s Site, including when you create an online account when applying for a job. PLEASE NOTE THAT WHEN YOU APPLY FOR A JOB WITH BLICK VIA THE SITE, DAYFORCE MAY COLLECT ANY INFORMATION YOU SUBMIT, INCLUDING PERSONAL INFORMATION. DAYFORCE MAY USE AND SHARE YOUR PERSONAL INFORMATION IN ACCORDANCE WITH THE DAYFORCE PRIVACY POLICY.
Further, Blick has no control over what types of cookies and other tracking technologies are used on the portions of the Site provided by Dayforce (and what Personal Information is collected and shared by those cookies and tracking technologies), which includes the pages where you view job openings, apply for jobs (with and without an account), follow-up on job applications, and otherwise view your job applications account. INSTEAD, PLEASE SEE THE DAYFORCE PRIVACY POLICY TO LEARN WHAT TYPES OF COOKIES AND TRACKING TECHNOLOGIES DAYFORCE USES, AND HOW YOUR PERSONAL INFORMATION IS COLLECTED, USED AND SHARED BY DAYFORCE AND ITS VENDORS.
If you would like to apply for a job with Blick and do not want your Personal Information shared with Dayforce, please contact us at retailrecruiting@dickblick.com to let us know, and we will make commercially reasonable efforts to find another method for you to submit your job application materials to us.
Please note that in certain situations Blick may enter your applicant information into the Dayforce Platform on your behalf if you are unable to do so or if you applied via another method that does not automatically integrate your applicant information with the Dayforce Platform, so long as you have not explicitly asked us not to do so. Any Personal Information entered into the Dayforce Platform on your behalf remains subject to this Privacy Notice.
"Personal Information" is any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual. Except as provided under applicable laws, Personal Information does not include information that is publicly available or information that has been deidentified or aggregated in a way that it cannot be used to identify a specific individual.
We may collect the following categories of Personal Information when you apply for a job with Blick, are in independent contractor of Blick’s, or during the course of your employment:

We may request certain Sensitive Personal Information from you in connection with your application or during your employment. Except where we are required to collect such information under applicable law (such as your social security number), providing us Sensitive Personal Information is voluntary.
We collect Personal Information about you from the following sources:
Information You Provide to Us Directly. We may collect Personal Information directly from you, for example, when you apply for a job, complete payroll and benefits forms, participate in benefits programs, sign a contract with us to be an independent contractor, or when you otherwise communicate with us.
Information We Collect Automatically / Electronically. We may collect Personal Information from you automatically, such as when we record customer service phone calls, when we use security cameras in our retail stores and manufacturing facilities, and otherwise when an employee uses any Blick provided equipment, software, platforms, and internet connections. More information can be found in Blick’s employee handbook and internal policies applicable to employees and/or independent contractors.
Information We Collect from Third Parties. We may collect Personal Information from third parties, including our affiliates, business partners, and service providers. For example, we receive information from recruiters, background and credit check service providers, and drug screening providers. We also may receive information from the references that you provided to us or from your current or past employers. In addition, we receive Personal Information from third-party social media platforms and job platforms such as LinkedIn, Facebook, Instagram and Indeed. If you connect with us via those platforms or otherwise have an account or use those platforms, we may contact you using those platforms, in which case each applicable platform’s privacy policy applies to their collection, use and sharing of your Personal Information while on their platform.

There are certain parts of our Site (excluding those portions of the Site run by Dayforce) where we engage third-party analytics and advertising partners to collect and use Personal Information so that we may learn more about the use of our Site and to provide targeted advertising to you. Those third-party analytics and advertising partners may use the Personal Information they collect for their own advertising and analytics purposes. As noted at the beginning of this Privacy Notice, any cookies and tracking technologies used on the portions of the Site provided by Dayforce, including what Personal Information is collected and shared by those cookies and tracking technologies, are controlled by Dayforce, and therefore are not subject to this Privacy Notice or Blick’s general Privacy Policy, but instead are subject to THE DAYFORCE PRIVACY POLICY.
You have the option to create an account when applying for a job through our Site. We will store any account information you provide and we may monitor activities under your account. Dayforce may have access to your account information, which they process in accordance with the DAYFORCE PRIVACY POLICY.
When a past or current employee applies for a job with Blick, any application-related information they provide is linked with their past and/or current employee file.
We may disclose Personal Information we collect about you when requested or consented to by you or to the following categories of affiliates, third parties and services providers for the purposes described in this Privacy Notice:
Affiliates. We share Personal Information with our affiliates for ours and their business purposes. For example, we may share your Personal Information with our affiliates if they have an open job posting for which you may be a good candidate. We may contact you to gauge your interest in these other positions.
Service Providers. We may disclose your Personal Information to third-party service providers to assist us with our recruiting, hiring, and administration of your employment, payroll, salary, and benefits, such as background check companies, credit check companies, companies that perform drug testing, recruiters and employment agencies, payroll providers, software service providers, learning resource management service providers, training service providers, human resource information systems service providers, data analytics providers and consumer reporting agencies in connection with pre-employment screening.
Social Media Companies and Job Platforms. When you connect with us using a third-party social media platform (e.g., LinkedIn, Facebook, Instagram) or a third-party job platform (e.g., Indeed, Dayforce) we may communicate with you using those platforms, in which case the operators or owners of those platforms may collect Personal Information about you which is subject to their respective privacy policies (not this Privacy Notice). We also may send back statistical information to those platforms (e.g., number of applications received and hires made), which it is possible those platforms could use to identify you.
Professional Advisors. We may share your Personal Information with our professional advisors, such as attorneys, accountants, financial advisors, insurance brokers and business advisors, in their capacity as advisors to use in our business, tax and legal matters.
Governmental Entities and Law Enforcement. We may disclose Personal Information about you to governmental authorities or law enforcement if required by law or if we reasonably believe that disclosing the Personal Information is needed to comply with any valid legal process, governmental request, or applicable law, rule, or regulation, to protect the company’s rights, property, and safety and those of our employees, customers, or others; or to detect and resolve fraud or security concerns.
Successor Entities. In the event Blick is subject to a merger, acquisition, or sale of its assets or another change of control, or in the case of a bankruptcy, reorganization or similar transaction, we will provide Personal Information in connection with the proposed or completed transaction, including that we may transfer your Personal Information to the subsequent owner(s).
We maintain reasonable administrative, technical, and physical safeguards designed to protect the Personal Information we collect and process from unauthorized or unlawful access, acquisition, use, disclosure, alteration, loss, or destruction. While we take these measures to protect your Personal Information, no method of transmission or storage is completely secure. If your Personal Information is impacted by a data breach, we will notify you as required under applicable law.
We do not hire individuals under the age of 18. We only collect and disclose the Personal Information of children under the age of 18 strictly for the purpose of administering benefits.
If you are a California resident, you may have additional rights under the California Consumer Privacy Act, as amended including by the California Privacy Rights Act, and their implementing regulations (collectively, the “CCPA”). This section only applies to you if you are a California resident. Capitalized terms in this Section that are not defined elsewhere in this Privacy Notice have the definitions set forth in the CCPA.
We Do Not Sell Personal information. In the past 12 months we have not Sold your Personal Information to a third party for monetary compensation.

Sensitive Personal Information. We only collect and share Sensitive Personal Information as necessary to comply with applicable laws, to perform our duties as an employer, to detect and avoid fraud or other illegal activity, to ensure the physical safety of individuals, and as otherwise requested by you. Except as required by applicable law, you may decline to provide Sensitive Personal Information to us.
California Residents’ Rights to Know, Delete, Correct, Data Portability, and Non-Discrimination. Subject to certain limitations such as (a) exceptions permitted by applicable law and (b) verification of your identity, you may request to exercise the following rights with regard to your Personal Information:
Right to Know. California residents have a right to know whether we collected any of the following in the prior 12-month period:

Right to Request Deletion. You have a right to request that we delete certain Personal Information we collected from you. In many cases, we may deny such requests because we are required to keep that information to comply with applicable laws, to administer employment or benefits, to defend against legal claims and investigations, or for other purposes permitted by the CCPA.
Right to Correction. You have a right to request that we correct inaccurate Personal Information in your records.
Right to Data Portability. You may request a copy of the Personal Information you previously provided to us in a portable and, to the extent technically feasible, readily usable format.
Right to Non-Discrimination. You have a right not to receive discriminatory treatment for exercising any of your privacy rights under the CCPA. If you are acting as a consumer and not an applicant or employee, please see our Privacy Policy for exceptions, such as when we offer financial incentive programs.
Rights Related to Automated Decision-making Technology. We do not currently use automated decision-making technology to make significant decisions regarding hiring, promotion, or termination. If we begin to use automated decision-making technology, you may have the right to receive notice, access meaningful information about the logic involved, opt out in certain contexts, and appeal adverse decisions, as applicable under the CCPA.
Right to Opt-Out of Sale / Sharing. If a Business Sells or Shares a California resident’s Personal Information, such resident has the right to opt-out of the Sale or Sharing of their Personal Information.

Verifiable Consumer Request. In order to verify your request to exercise your rights described in this Privacy Notice, you must provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information, and you must describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. To verify your identity, we may ask you to log into your account (if you have an account with us) or provide additional information. When seeking additional information from you, we may contact you through your account or the contact phone number or email address you provided in your request. If we cannot verify your identity, we may deny your request.
We will only use Personal Information we collect during the verification process for the purpose of verifying your identity. If we are unable to verify your identity as required by applicable laws and regulations, we will decline to comply with your request and let you know why.
Who May Exercise Your Rights / Using an Authorized Agent. You may only make a request to exercise your rights on behalf of yourself. A parent or legal guardian may make a request on behalf of their child. You also have a right to submit requests to exercise any privacy right through an authorized agent. If you choose to use an authorized agent, you must (a) provide signed permission to that authorized agent to submit requests on your behalf and (b) verify your identity. We may deny a request from an authorized agent if we do not have proof that they are authorized by you to act on your behalf.
When We Will Respond. We will try to respond to your request within 45 days. If we require additional time, we will inform you of the reason and extension period. When you make a request to know what categories of Personal Information or specific pieces of Personal Information we collected about you, we typically provide a response for the time period going back 12 months from the date of the request. However, upon your request, we can provide that information going back as far as January 1, 2022 if it is not disproportionately burdensome. For data portability requests, we will select a format to provide your Personal Information to you. We may charge a fee to process or respond to your request if it is excessive, repetitive, or manifestly unfounded.
Required Legal Notice About Children’s Personal Information. We have no knowledge of having Sold or Shared the Personal Information of children under the age of 16 years old.
Shine the Light. Pursuant to California Civil Code Section 1798.83, if you are a California resident, you have the right to obtain: (a) a list of all third parties to whom we may have disclosed your Personal Information within the past year for direct marketing purposes, and (b) a description of the categories of Personal Information disclosed, by contacting us per the “Contact Us” Section below.
